| New Hampshire is the first state in the U.S. to pass an "early offer" law, which allows patients injured by medical malpractice to accept a lump-sum settlement in favor of pursuing drawn-out litigation. However, the program excludes certain damages, such as future earning capacity, and patients who reject the offer can end up on the hook for the medical provider's legal fees.
"To call this an early 'offer' program is an injustice to the concept of an offer," professor Teninbaum told Trial News, a publication of the American Association for Justice. |
