This is the second day of a two-part program intended to explore the legal issues which were created by the Supreme Judicial Court decision in the same-sex marriage case, Goodridge v. Dept. of Public Health. We will also examine legislative responses to the decision. Part I explored the decision itself, with a discussion by the lawyers who argued the case. A panel discussion examined the issue of whether the decision must be given comity in other states and the application of the federal Defense of Marriage Act as well as constitutional issues which could arise in a legislative response to the decision. Part II of the program will explore the practical application of the decision to day to day legal practice. This will include analysis of support and custody issues in family cases, benefits issues under federal and state law, employment benefits, problems of estate planning and tax law, divorce and application of rules of evidence regarding marital privileges. There will be opportunities for attendees to ask questions throughout both parts of this program.

Who Should Attend:
Lawyers whose traditional practice includes clients from the Gay and Lesbian community, general practitioners interested in expanding their practice into that community, specialists in family law, estate planning and benefits lawyers whose practice is likely to be impacted by the same-sex marriage decision and judges interested in the constitutional and practical issues raised by the decision.

Walk-Ins:

Refunds:  

Written requests for cancellations received via fax or email 24 hours prior to the program will be granted a refund, minus a $15 charge. If you cannot attend, you can send a substitute, otherwise you will receive the written course materials.
