Significant changes to the Medicaid laws have been made by courts and the legislatures of the New England states over the past year - some good, some bad, all important to elder law practitioners. Some of the changes include:

  • Connecticut’s refusal to recognize a federally sanctioned special needs trust as an exempt asset trust for determination of eligibility for the state’s supplemental program
  • Maine’s proposed prohibition of the authority of probate judges to allow gifting by guardians and conservators, and proposed expansion of estate recovery to any assets owned wholly or partially by the benefits recipient, including jointly owned real estate
  • Vermont’s new Power of Attorney law
  • Block grants in New Hampshire
  • Rhode Island’s decision to include out-of-state residences as countable assets
  • Repeal of expanded estate recovery in Massachusetts

This program will advise attendees of these changes, inform them of the current status of the seminal cases in the elder law arena, and offer strategies for planning under the various changes. The program will include two workshop sessions offering participants the opportunity to brainstorm and learn from their fellow elder law practitioners. The morning workshop will focus on Medicaid Planning strategies under the then current Medicaid laws. The afternoon session will include a focus on guardianship issues and family law issues in the elder law practice.

Attend and Learn:
  • The status of federal waiver legislation filed by various states, including Massachusetts and Connecticut
  • Which planning strategies are still available and what new strategies have been developed in response to new eligibility rules
  • How other elder law attorneys are advising their clients in this environment of uncertainty

Tuition is $199; $179 for attorneys admitted to the Bar after 2001, members of NAELA and education subscribers and members of GCM-NE. Course book, a continental breakfast and luncheon included in the tuition charge.



Walk-Ins:  

Space is limited. Registrations at the door are welcome, but please register in advance to reserve a seat and your written course materials or call to confirm space availability.



Refunds:  

Written requests for cancellations received via fax or email 24 hours prior to the program will be granted a refund, minus a $15 charge. If you cannot attend, you can send a substitute, otherwise you will receive the written course materials.
