The high degree of emotionality and psychological turmoil on the parts of divorcing individuals commonly leads to disruptions in the legal process, increased risk for the families involved, and a drawn out process that is more difficult and stressful for the lawyer and the client. One quarter to one half of all communications between lawyers and divorce clients is about the client’s emotional state. While 89% of attorneys state the importance of attending to this, fewer than half believe that they know what to do.
This unique program will teach lawyers the knowledge and hands-on skills to work with clients in ways that will keep the emotions contained, the client focused, and outcomes more efficiently reached. Using a case format and live applications of the material taught, participants will come away from the workshop better able to build client relationships that are less susceptible to emotional disruption and better able to contain clients during times of high conflict.
COURSE CONTENT: - The psychology of divorce meets the legal system – what actually happens between lawyers and clients
- Signs and indicators of difficult clients – how to know with whom you are really working
- Interactive discussion re: how to manage different types of clients
- New strategies and techniques for more effective lawyering with these clients
- Role play and rehearsal – internalizing the skills and incorporating your style
AS A RESULT OF THIS PROGRAM, YOU WILL BE ABLE TO: - Understand attorney-client dynamics as they play out in divorce cases
- Identify and differentiate different types of problematic clients
- Recognize the challenges to representation a particular client will present
- Choose from a variety of skills and techniques to deal effectively with such clients reduce their own stress and increase practice satisfaction and offer a less chaotic and damaging legal process to their clients.
DR. SANFORD M. PORTNOY is Director of The Center for the Study of Psychology and Divorce at the Massachusetts School of Professional Psychology. He is a nationally recognized expert in the use of psychological interventions to reduce the emotional impact and harm of divorce, and for teaching lawyers the skills to effectively manage difficult and highly emotional clients. He has presented at a number of national lawyers conferences, has provided workshops and institutes for lawyers and judges around the country, and has written for a number of family law and psychology publications.
