Medicaid continues to be an ever changing landscape with continuous court and legislative activity on the federal level and in most states during 2005. The President has appointed a federal Medicaid Commission to “study” the Medicaid issue, but voting members of the committee have been largely stacked with administration appointees. The state Governors have also waded in with their own report, but are split over a solution.

Some of the major state changes include: Connecticut withdrawing its proposed waiver; Legislative proposals in Massachusetts that would allow the maximum community spouse resource allowance; and New York’s interesting “compact” to provide private-public support for long-term care.

This year’s Elder Law Symposium has been expanded to include New York with time dedicated to the New York compact and its potential impact on other states. The Symposium presenters will advise attendees of the changes, inform them of the current status of the important cases in the elder law arena, and offer strategies for planning under the various changes. In addition to a discussion of legislation and policy changes, the symposium includes a panel on trusts and a workshop for discussion of difficult trust issues offering participants the opportunity to brainstorm and learn from their fellow elder law practitioners. For those interested in focusing on policy, there is an alternative session covering the interesting New York compact proposal.

    Woods Oviatt Gilman LLP, Rochester, NY

    Mr. Reixach a partner in Woods Oviatt Gilman LLP in Rochester, New York. He is a graduate of Yale College and Harvard Law School and has litigated Medicaid eligibility issues in the federal and state courts for nearly three decades, including federal district court cases in five states and one case in the Supreme Court of the United States. He is a frequent CLE lecturer on Medicaid eligibility for the New York State Bar Association, the National Academy of Elder Law Attorneys, and other Bar Associations. He is a Fellow of the National Academy of Elder Law Attorneys, and he is a member of the Executive Committee of the New York State Bar Association Elder Law Section, from which he received the Outstanding Practitioner award in 2001.
