States, with the blessing of CMS, have been developing increasingly restrictive interpretations of the Deficit Reduction Act of 2005. The initial predictions of what works and what doesn’t work to safeguard the independence and dignity of families facing long-term-care have been turned on their heads in the last twenty months. Many elder law attorneys have reluctantly resigned themselves to the reality of a five year planning horizon for Medicaid planning where there is no community spouse. That need not be the case.

Attend this dynamic and practical Symposium to learn what legal techniques your fellow practitioners in the Northeast have been successfully using in their respective states to cope with the draconian effects of the DRA of 2005: strategies that you may be able to implement in your practice to help your clients. You will learn that there are significant differences in how some states treat certain assets. That knowledge, combined with geographical considerations, may lead clients to consider residing in another state. Come learn whether there is a significant difference in the eligibility requirement of neighboring states that may benefit your clients.

Elder law attorneys have not traditionally used the Probate & Family Courts to develop or implement their Medicaid strategies since simpler remedies existed prior to the passage of the DRA of 2005. With the passage of the DRA of 2005, the courts have become a viable and attractive resource in which to provide for the dignity and independence of families facing the prospect of the long term care placement of a loved one. You will learn about successful Medicaid strategies implemented by using the Probate & Family Courts in various states and the planning opportunities that may exist. Learn the ins and outs of “spousal refusal” to safeguard the community spouse as well as the use of “spousal support petitions” and creative use of guardianships.
