After being dormant for many decades, patent law has experienced substantial attention over the past few years. Numerous media stories in the popular press have reported on problems with the patent system. The U.S. Supreme Court granted certiorari on an unprecedented number of patent disputes. Some of their decisions upset long settled precedent while others created new uncertainties. Congressional action in the area of patent reform has resulted in numerous proposed reform bills which have pitted different industries against each other, resulting in years of legislative gridlock. The USPTO enacted sweeping new rules governing patent prosecution which were promptly challenged in court resulting in issuance of a preliminary injunction against implementation of the rules.

The turmoil and uncertainty in patent law makes it difficult for business enterprises to make strategic business decisions. Already challenging decisions on R & D, capital investment and long term IP strategy become ever more complex when the law is uncertain.
