Just as consumers' use of credit and debit cards has grown exponentially, so has the problem of identity theft. State governments have responded with laws and regulations which require notice of breaches of the security of personal information and to set new expectations with regard to the collection, use and proper disposal of personal information. In October 2007, M.G.L. c. 93H took effect, requiring that breaches of the security of personal information be reported, and that personal information be securely destroyed when no longer needed. Subsequently, the Office of Consumer Affairs and Business Regulation promulgated 201 CMR 17.00, which establishes standards for protecting personal information and computer system requirements for all businesses, non-for-profits, and any other person or organization holding personal information about Massachusetts residents. The Governor also issued Executive Order 504, which requires executive agencies to employ certain data security policies and procedures.
