Copyright for Fashion Design? Fashion is one of the world’s most important creative industries. As the most immediate visible marker of self-presentation, fashion creates vocabularies of self-expression that relate individuals to society. Despite being the core of the fashion industry and legally protected in Europe, fashion design lacks protection against copying under U.S. intellectual property law. Should Congress create copyright protection for fashion designs? What should be the scope of such protection, and how might it differ from copyright in other types of creative work? What would the proposed Design Piracy Prohibition Act achieve? What is the effect of the current legal regime, which protects trademarks but not fashion designs from copying? These questions induce us to reflect on the broader cultural dynamics of innovation as a social practice in which consumption is also expressive. Presenter: Jeannie Suk, Assistant Professor of Law, Harvard Law School Jeannie Suk will discuss her article co-authored with C. Scott Hemphill, The Law Culture, and Economics of Fashion, published in Stanford Law Review. Her work on legal protection for fashion design has been profiled by the Boston Globe. Her book, At Home in the Law, was awarded the Law and Society Association’s prize for most outstanding book of 2009. Before joining the Harvard faculty in 2006, she served as a law clerk to Justice David Souter on the United States Supreme Court, and to Judge Harry Edwards on the U.S. Court of Appeals for the D.C. Circuit.
