About the Program


The recent Supreme Judicial Court ruling in Ansin v. Craven-Ansin shed new light on the efficacy of Marital Agreements and established the standards for determining the validity of and enforcing these agreements. In order to protect against coercion, fraud or overreaching, Justice Marshall as the author of the opinion emphasized that these types of agreements, while not against public policy, would be subject to greater scrutiny and in some respects, be subject to more rigorous standards than those applied to Premarital and Separation Agreements. While concurring with many of the ALI Principles, her opinion also identified several distinctions with those principles.

This program provides you with analysis about the differences and similarities of Premarital, Marital and Separation Agreements as well as how Ansin has changed practice for family lawyers and estate planners. You will hear about the issues of concern to the Justices and what issues remain unresolved.
