About the Conference
Recent cases in the Supreme Judicial Court have resulted in major changes in tort law creating new theories of liability and recovery. The Fifth Thomas F. Lambert, Jr. conference brings together top legal practitioners, judges and academics to reflect on how the Court is remaking a trilogy of negligence specialties: (1) Social Host Liability, (2) Premises Li-ability, and (3) Medical Liability and the implications of the new torts decisions for trying cases. This practical conference provides the best available guidance on discovery, trial tactics, and practice pointers in these three complex negligence specialties. The SJC has long been a maker of tort law. Lemuel Shaw authored the landmark decision of Brown v. Kendall, (6 Cush.) 292 (1850) and the SJC became the first court in Anglo-American history to hold defendants to a reasonable care standard jettisoning the archaic writ of trespass. Tom Lambert often re-marked that all torts had a birthday and the birth of negligence was in 1850. The Massachusetts Supreme Judicial Court of the new millennium continues to be a tort trend-setter in its recent decisions in snow and ice, loss of chance and slip and fall.
