ABOUT THE CONFERENCE

As of July 8, 2012, the MUTC went into effect signifying the first time Massachusetts’ trust law has been codified. With a few exceptions, the MUTC is applicable to all trusts in existence before, on or after the effective date and the provisions of the MUTC impact all aspects of trust administration. Concentrating on the practical application of the MUTC, the in-depth discussion will focus on ten select provisions of the MUTC. Among the issues to be discussed are:

  1. What impact does the MUTC have on the common law? To what extent does Section 105 now permit settlors to draft around the common law?

  2. Who is a qualified beneficiary and why does it matter?

  3. What is the scope of a trustee’s duty to keep the beneficiaries of a trust informed regarding the trust’s ad-ministration? May the settlor draft around the duty to inform?

  4. How have revocable trusts changed?

  5. How does virtual representation work under the MUTC?

  6. What is the role of the Court in utilizing the MUTC?

  7. Does the MUTC provide new standards for removing a trustee?

  8. What does the MUTC provide regarding judicial modification and termination of trusts? What opportunities does the MUTC provide for a trust to be modified without court involvement?

  9. Does the trustee of an existing testamentary trust continue to have an obligation to account to the Probate Court?

  10. What impact does the MUTC have on the duty of loyalty?
