Many cases have connections with more than one state, or with a state and a foreign country, or involve both state and federal interests. This course explores the principles courts use in selecting the proper law to apply in such cases under the American system of divided sovereignty - divided both horizontally among states and vertically between state and federal governments. The course will cover choice of law under the First Restatement and "modern" choice of law theories, constitutional constraints on state choice of law, conflict choice of law in federal courts, intersystem aspects of res judicata and the respect due to judgements under full faith and credit principles or in an international setting.
