The licensing of software has evolved as the chief mechanism for transferring value in the information age economy. This course will cover software licensing as well as other software contracting issues addressed by the Uniform Computer Information Transactions Act of 1999. Software law covers topics such as software contracting, information security, computer malpractice, torts arising from defective software, computer crimes, privacy, First Amendment and controls over encrypted software. This course will provide students with a background on how software copyrights, software patents, trademark law, the law of trade secrets, and trade regulation law apply to software. Finally, the course will draw comparisons to how the U.S. protects software with European Community Directives and foreign legal systems.
