COURSE DESCRIPTIONS


Conveyancing and Mortgage Law
Mr. Marshall Davis
2 credits day; 2 credits evening.

Registration for both Conveyancing and Mortgages, and Real Estate Mortgages Law and Conveyancing is prohibited.

This course will examine particular aspects of conveyancing (the transfer of ownership of real estate) in a transactional context. The select topics will be covered include: a conveyancing attorney's professional responsibility; the offer to purchase; the purchase and sale agreement; title examination; land registration; title insurance; adverse possession; easements; restrictions; zoning and subdivision; condominiums and cooperatives; mortgage financing and closings.


Faculty comments: The Conveyancing and Mortgage Law course as taught by Professor Davis is primarily taught through a lecture format with occasional in class group problem solving. The course attempts to balance the academic (i.e. the study of specific cases and statutes) with the practical (e.g. analysis of the negotiation process involved in Offers to Purchase, Purchase and Sale Agreements, etc.), There is particular emphasis on real world application of the course content. There is a closed book final exam which typically consists of between 10 and 15 short essay type questions covering most of the course topics. Although class participation is not graded, it is strongly encouraged, as the class and the teacher benefit from student involvement. The last class is generally devoted to the final exam and several sample exam questions are typically offered for class discussion. A study guide outline is provided to the class members at that time so to assist them in focusing their study for the final exam.
