Advanced Civil Procedure

This course will build upon the fundamentals of civil procedure that you learned during your first year of law school. Initially, we will identify the basic tenets of our adversary system and compare the structure and principles of our system with dispute resolution systems employed in other countries. We will then discuss how civil litigation has evolved to respond to contemporary disputes involving large groups of litigants seeking potentially inconsistent judgements (frequently referred to as "complex litigation") and we will discuss the appropriate procedural treatment for such cases. Some of the major topics that we will discuss include joinder(voluntary, compulsory, class action, interpleader and intervention), preclusion, jurisdiction, venue, and choice of law.
