Insurance Litigation

2 credits day; 2 credits evening.

The course examines the process of the interaction of the claimant and/or policyholder and the insurer through the filing, investigation and acceptance or denial of the claim. It also examines the process of filing of litigation in a disputed clain, the burden of proof, the process delivery, potential motions, use of arbitration/mediation in the potential resolution of claims and the trial. It also examines the professional and legal issues surrounding the tripartite relationship among insurer, defense counsel, and policyholder. The course also examines some of the principles of civility and professionalism, which ideally should direct the actions and behavior of lawyers in the conduct of their relationship with claimants and claimant's counsel.
